www.thebodyshop.com, whether accessed via a personal computer or a smart phone ("the Website") is operated by The Body Shop. The purpose of the Website is to provide you with information about the business of The Body Shop International Limited, our products and stores, the campaigns that we support and the activities we undertake.

Please read this document carefully as it contains the terms and conditions that you agree to be bound by when you access, browse, use, register with, or place an order on our Website. If you do not agree to these Terms of Use, stop using the Website immediately.

The purchase of any of our products from The Body Shop Online Store will also be subject to our Terms & Conditions of Sale ("the Conditions"). In the event of any conflict between these Terms of Use and the Conditions, then the Conditions shall prevail.

1. INFORMATION ABOUT THE BODY SHOP

1.1 The Body Shop International Limited ("The Body Shop", "we", "us" or "our"). We are registered in England and Wales under company number 15859787, with our registered office at Watersmead, Littlehampton, West Sussex, BN17 6LS, UK. Our UK VAT registration number is GB494271566.

1.2 The Body Shop is fully committed to the responsible collection, use and care of personal information. The categories of personal information that that we process about you will depend on how you use our services and interact with us. All personal information is processed in accordance with our Privacy Policy.

2. ACCESSING THE WEBSITE

2.1 We have taken appropriate care in the preparation of the Website. However, as certain technical matters may be beyond our control, we cannot guarantee that you will have continuous, uninterrupted or error-free access to the Website at all times. Our Website is made available free of charge and The Body Shop may suspend, withdraw, discontinue, update or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable.

2.2 You are responsible for ensuring that your computer system and internet connection meet all technical specifications needed to use the Website and are compatible with the Website. You understand that we are unable to and do not guarantee or provide any warranty that the Website content will be free from any virus, infection, code or similar issue that has potentially contaminating or destructive properties. It is your responsibility to ensure you have sufficient virus checks and procedures (including anti-virus checks) to satisfy your particular requirements for the safety and reliability of any data inputted into and accessed/downloaded from the Website.

3.1 We may need to from time to time restrict access to some parts and/or features of the Website. If you have a registered account for our Website, you must treat your login information (including your email address and any one-time passcodes) as confidential and you must not disclose it to any third party. We have the right to disable any registered accounts at any time if, in our reasonable opinion, you have failed to comply the provisions of these Terms of Use.

5. use the Website in any manner or for any purpose that infringes, misappropriates or otherwise violates any intellectual property right or other right of any third-party or that violates applicable law;
6. use the Website to store or transmit any code, files, scripts, agents or programs intended to do harm, including but not limited to viruses and malware of any kind;
7. use the Website if (i) you are located in a country which is subject to a sanctions or embargo which impact the Website or the use of similar services, or has been designated a 'terrorist supporting country'; or (ii) you are listed on any government list of prohibited or restricted persons; and/or
8. attempt any of the foregoing.

3.3 We may limit the availability of the Websites to any person or geographic area at any time at our discretion.

4. TEXT OR DATA MINING OR WEB SCRAPING

4.1 You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Website or any services provided via, or in relation to, our Website for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):

1. any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our Website or any data, content, information or services accessed via the same.
2. any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

4.2 The provisions in this section should be treated as an express reservation of The Body Shop's rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

4.3 You shall not use, and we do not consent to the use of, our Website, or any data published by, or contained in, or accessible via, our Website or any services provided via, or in relation to, our Website for the purposes of developing, training, fine-tuning or validating any AI system or model.

4.4 This section will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

5. INFORMATION ON THE WEBSITE

5.1 The information on the Website has been included in good faith for general informational purposes only. It is not intended to amount to advice on which you should rely upon. Except to the extent that our Conditions and/or Privacy Policy apply, we make no representation or warranty that any Website content is accurate, up to date or complete. To the fullest extent permitted by law, The Body Shop accepts no liability for any loss or damage caused by any reliance placed on any Website content by you or anyone to whom you communicate or share such information with.

5.2 If you find any inaccurate information on the Website, please let us know. Where we agree that information is inaccurate, we will endeavour to correct it as soon as reasonably practicable.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 The Body Shop is, unless otherwise stated, the owner of all intellectual property rights in the Website and the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

6.2 You may print off one copy, and may download extracts, of any page(s) from our Website for your personal use and you may draw the attention of others to content posted on our Website. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

6.3 Our status (and that of any identified contributors) as the authors of content on our Website must always be acknowledged (except where the content is user generated).

6.4 You must not use any part of the content on our Website for commercial purposes without obtaining a licence to do so from us or our licensors.

6.5 If you print off, copy, download, share or repost any part of our Website in breach of these Terms of Use, your right to use our Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made (except that you are permitted to print off a copy of these Terms of Use).

6.6 All brand, product and service names or logos used in this Website are the trademarks, trade names or service marks of The Body Shop unless otherwise stated. You may not market or distribute products or offer services under or by reference to or otherwise use or reproduce any such trademarks, trade names or service marks without the prior written permission of The Body Shop International Limited or the owner of such trademarks, trade names or service marks. Nothing contained on the Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the Website.

7. USER GENERATED CONTENT

7.1 By submitting content to the Website, including any Reviews that you may submit, you represent and warrant that:

1. you are the sole author and owner of the intellectual property rights in the content you submit;
2. you have voluntarily waived all and any 'moral rights' that you may have in such;
3. all content you submit, including any Reviews you submit, is accurate and honest;
4. you are at least 18 years old;
5. use of the content, including the publishing of any Reviews by The Body Shop in accordance with our Reviews Policy, does not violate these Terms of Use and will not cause injury to any person, organisation or entity; and
6. you are using our Website for your own personal purposes and are not using our Website for any commercial purpose.

7.2 For any content that you submit to the Website, you grant The Body Shop a worldwide, perpetual, irrevocable, royalty-free, non-exclusive and transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, market, advertise, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

7.3 You acknowledge that you (not The Body Shop) are responsible for all content you submit to the Website. Any content, including any Reviews that you submit, do not reflect or represent the views of The Body Shop. None of the content that you submit shall be subject to any obligation of confidence on the part of The Body Shop or its agents, affiliates, partners or third party service providers and their respective directors, officers and employees.

7.4 You agree and warrant that you will not submit any content:

1. you know to be false, inaccurate or misleading;
2. where you have been compensated or provided any consideration for by any third party;
3. that violates any law, statute, ordinance or regulation;
4. that infringes any third party's intellectual property rights, rights of publicity or privacy rights;
5. that contains any viruses, infection, code or similar potentially damaging computer programs or files;
6. that is, or may reasonably be considered to be, obscene, offensive, harmful, defamatory, vexatious, threatening or harassing, libellous, racially or religiously biased to any third party; and/or
7. that is repeatedly submitted.

7.5 Our use of user generated content: All content that you submit may be used at The Body Shop's sole discretion. The Body Shop reserves the right to change, condense or delete any content on the Website that The Body Shop deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. We do not guarantee that you will have any recourse through The Body Shop to edit or delete any content you have submitted, including any Reviews. Reviews, ratings and written comments are posted in accordance with our Reviews Policy and The Body Shop reserves the right to remove or to refuse to post any review that does not meet our guidelines and standards.

7.6 Content not approved: Our Website may include information and materials uploaded by other users. This information and these materials have not been verified or approved by The Body Shop. The views expressed by other users on our Website, including in any Reviews, do not represent our views or values.

8. RULES ABOUT LINKING TO OUR WEBSITE

8.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

8.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

8.3 You must not establish a link to our Website in any website that is not owned by you.

8.4 Our Website must not be framed on any other site, nor may you create a link to any part of our Website other than the home page.

8.5 We reserve the right to withdraw linking permission without notice.

9. LINKS TO OTHER WEBSITES

10. DISCLAIMER OF WARRANTIES AND LIABILITY

10.1 To the fullest extent permitted by law all warranties (express or implied) in respect of the Website and the content of and your use of the same are excluded. Except in the case of death or personal injury caused by our negligence or our responsibility for any fraudulent misrepresentation, to the fullest extent permitted by English law we exclude all liability to you in respect of your use of this Website.

11. GENERAL

11.1 We reserve the right to change these Terms of Use without notice to you from time to time. Any such amendment shall be effective once the revised terms have been posted on the Website.

11.2 These Terms of Use, including where applicable the Conditions, constitute the entire agreement between The Body Shop and you in relation to your use of the Website.

11.3 If any provision of these Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

11.4 These Terms are governed by and will be construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English Courts.
